Terms of service
1. Background
Micke P Golf AB 556691-9527 (hereafter "MPGAB") provides the Golf4u service (hereafter "the Service"). The content of the Service is updated on a rolling basis. These terms of use apply and are legally binding for every user of this website. Before using the website you must read and accept the terms.
2. Access to the service and right of withdrawal
MPGAB grants the customer a non-exclusive right to use the Service via the internet during the contract period (which may vary depending on which course the customer has bought). Access is granted to a specific named individual through registration as a customer and payment of the course fee.
MPGAB does not guarantee that the customer will obtain a Green Card. We only provide support for the customer's learning. The Service follows the national rules for the Green Card and handicap 54 as decided at each annual meeting of the Swedish Golf Federation. If the rules change in the future, section 11 "Changes to the service" applies.
If you have entered into an agreement with MPGAB you have, under Swedish distance contracts and off-premises contracts law (2005:59), a right of withdrawal within fourteen (14) calendar days and are entitled to a full refund. The 14-day period starts as soon as you register your purchase. By starting to use the Service and watching the content available through your course you consent to waiving your right of withdrawal. Notice of withdrawal must be sent by email to info@golf4u.se as soon as possible.
3. Technical requirements
MPGAB charges no extra fees for using the website via mobile devices like tablets or phones. The site is built and optimised for the most common browsers and devices (computers, phones, tablets) that are not older than three years. Keep in mind that video streaming can consume a large amount of data, which may lead to additional data/mobile costs. MPGAB cannot influence — and is therefore not responsible for — limitations in transfer speed related to the customer's equipment, software and/or internet subscription.
Golf4u uses cookies to give the customer access to various features. The customer must allow cookies in order to use Golf4u as intended. Click here for more information about cookies.
4. Age limit
You must be over 18 to buy a course from Golf4u. With the consent and payment responsibility of a legal guardian, a minor can also become a customer.
5. Processing of personal data — GDPR consent
When the agreement is entered into you consent to MPGAB processing and storing your personal, organisational and company data in accordance with this agreement. MPGAB has the right to process and store data that uniquely identifies a person, company or organisation in order to carry out the agreed assignment and comply with laws governing quotes, invoicing and bookkeeping. MPGAB has the right to publish this data within systems/tools/cloud services provided by sub-suppliers used within our own organisation.
You have the right to information about what data MPGAB stores about you and how it is processed. You also have the right to request rectification or deletion of this data. Such requests should be sent in writing, signed, or via a verified email address to MPGAB. MPGAB will delete all customer data provided the information is not required for legal or valid business reasons.
MPGAB's goal is to keep services in a state where information is not accidentally destroyed or corrupted. This means information may remain in backup systems for a limited time. You have the right to file a complaint about MPGAB's role as personal data controller with the supervisory authority (the Swedish Authority for Privacy Protection).
MPGAB commits to:
- Only use data for internal use to fulfil the agreement and legal requirements.
- Not transfer or sell data to third parties unless required to fulfil the assignment.
- Not transfer or sell data to countries outside the EU/EEA.
- Apply the security measures required of MPGAB by law.
6. Security for username and password
When registering for Golf4u you need to provide an email and password. This information must be kept confidential and must not be shared with any third party. The username/email and password may only be used by you. If you suspect someone else is using your username/email and password you must immediately notify us and change your password. If MPGAB suspects abuse we reserve the right to disable the Service for you — without refund — in order to prevent unauthorised access.
7. Copyright and intellectual property
All content on the website is protected by Swedish copyright law. All copyright and other intellectual property rights belong to MPGAB. MPGAB grants you the right to use the website for private and personal use only, unless otherwise agreed in advance. You must not copy or publish the content in any way to make it available to the public, nor let anyone else do so. You must not share content from the Service in ways that enable unauthorised access. In case of breach or suspected breach of these terms, MPGAB reserves the right to disable the Service for you without refund, and may additionally claim damages for the losses caused.
8. Liability for faults
The Service may, due to maintenance, updates, technical faults, high load or other reasons, be out of service or partially unavailable for shorter or longer periods. If the Service is completely unavailable for longer than the customer can reasonably accept, the customer is entitled to a refund corresponding to the course fee for the time the Service was out of service, provided that written notice of the fault is received by MPGAB no later than thirty (30) days after the fault occurred. In other respects, MPGAB has no liability for the Service's function or quality or for its content. Apart from the above refund obligation, MPGAB has no other obligations for faults and is therefore not obliged to pay any other compensation, direct or indirect, caused to the customer.
9. Force majeure
Neither party is responsible towards the other party for fulfilment of obligations prevented by circumstances outside the party's or its suppliers' control, including but not limited to war, natural disasters, lockouts or other labour disputes, fire, damage to equipment used, changes to governmental requirements, interruptions in public communications (including energy supply and computer viruses in the Service), and import/export bans and other prohibitions outside the party's control.
10. Assignment and termination
This agreement is only valid for individual users. You may not transfer this agreement to another party. If the customer breaches its obligations above, access to the course ends immediately. The customer is then liable to compensate MPGAB for any damage the breach causes.
11. Changes to the service
MPGAB reserves the right to remove, change or add features to the Service at any time and/or remove parts of its content. If future changes to the national Green Card rules lead to the Service being limited, neither party can be held liable towards the other.
12. Changes to the terms of use
MPGAB has the right to change Golf4u's terms of use without prior consent from the customer. When changes affect existing users, the revised terms are sent to the customer by email.
13. In case of sale/transfer of Golf4u
If Golf4u is sold to another market player, Golf4u has the right to replace the customer's existing course with a new equivalent course that fulfils the same purpose, provided by the new owner.
14. Added value through partnerships
If there are added values for the customer when purchasing a Golf4u course, where the added value is provided by an external partner, Golf4u has no obligation to compensate if, for example, the external partner cannot fulfil the added value. This can happen if the partner goes bankrupt or for other reasons changes their business such that they cannot fulfil the added value that was part of the purchase.
15. Governing law and jurisdiction
If a dispute arises between MPGAB and the customer, the parties shall first try to resolve the dispute through mutual agreement. If the parties cannot agree, the dispute can be settled by the Swedish National Board for Consumer Disputes, to the extent that the board is competent to hear the matter and the dispute is suitable for consideration. Swedish law applies to the customer agreement. Disputes arising from the agreement shall be settled by a Swedish general court.
16. Discount codes
Personal discount codes must not be misused and are only intended for the specific person who received them. If someone else's discount code is used, MPGAB reserves the right to exclude the customer from Golf4u. The customer is then liable to compensate MPGAB for any damage the breach causes.
